Congratulations to Clearwater, Fletcher and Kingston on their victories for week 2 of the competition. Many teams have completed round 3 and only Fletchers and Kingstons have completed 4 pre-finals rounds deciding the top of the table for League 1.

Fletcher Construction has now won two close fought matches against Quantum Meruit Thermosashers with a 118 to 98 win in 2009 and a 117 to 99 win in 2010.  Both teams pictured after the 2010 match facing the bar (some kneeling before the bar) before a sinking cold one together in the spirit of friendly competition.

Massey Mentor-Mentee ‘get-together’

An informal mentor-mentee evening was held at the Massey Campus on Monday 13 September, 2010. Approx 50 people showed up, the majority being students.  20 of the students who attended currently do not have an assigned mentor.  They expressed interest in actively seeking a mentor for which we will assist. Murray Wilson opened and closed the evening, Jasper Mbachu spoke on student matters, specifically the requirement of a student spokesperson and Richard Maiden spoke on the roles of the mentor and mentee together with benefits of the programme.

Following this a student spokesperson was elected out of 5 volunteers.  The election process was impromptu, a lot of fun and managed well by Mr Naseem Ameer Ali (Senior Lecturer).  Each student was upstanding and given 1 minute to convince why they should be elected.  They were then ushered out of the room and in true diplomatic style the voting began.  Emily Chapman was the clear winner and we congratulated her as the 1st Massey University student spokesperson for the NZIQS mentoring programme.  Murray Wilson volunteered to be spokesperson for the NZIQS mentoring programme.  He will be Emily’s first point of contact relating to student matters and vice versa.  This will create not only efficient but effective levels of communication across all boards.

The evening was successful on many fronts; great turn-out, positive input from mentor’s, election of a student spokesperson, enthusiastic student input in relation to their requirements e.g. access to other mentors (besides their nominated one) from varying roles of the quantity surveying roles and site visits etc.  Moving forward discussions were held around setting dates for casual get-togethers, organising site visits and guest speakers.  These functions will be as far as possible, based on current student studies in order to gain best benefits.  Emily Chapman has been invited to the next Auckland Branch Board meeting on 1st October, 2010.  Where she will be report back on the evening and in general speak on behalf of the students.  Thank you to everyone for their attendance and contributions which made for a great evening.  Here’s looking forward to many more functions.

UK QS Salaries Plummet – Build.co.uk

“Salaries for employees have plummeted across the vast majority of roles, new research exclusive to Building has revealed.  Contractors’ quantity surveyors at all levels have seen the greatest fall in salaries over the last 12 months, with senior quantity surveyors’ earnings falling by nearly 5% and assistant quantity surveyors dropping by almost 8%.”

Response to fast tracking CPD and Reg.QS accreditation…

“Interestingly, I haven’t found that not being Registered has affected my work source. This may be due to the current market & reduced workload.  My main concern was requirements of the banks & lending institutions to use only Reg.QS's but to date I haven’t found this to be the case.  Maybe Reg.QS's is not perceived to be a higher qualification - although I or the Institute believes it should be perceived as such.”

[Editor – Thank you senior member.  The effect of Reg.QS on the marketplace to date has been small as the focus of NZIQS has been on educating members via communications and CPD, of the standards expected of a senior qualified practicing QS’s inclusive of management, estimators and administrators, consultants and contractors. That job, now established and ongoing, will soon be supplemented by getting the same message across to external parties who use QS services. We recommend ALL qualified members “Think CPD Accreditation” followed by Registration.]

Modern professional communications

Stephen Nayda of BDO talked about communicating at Conference 2010 in Tauranga, gosh that was a long time ago now, what with earthquakes, storms and we completely missed the RWC2011 one year to go launch campaign.  Anyway Stephen ran a simple DISC test on the conference attendees and delivered a clear profile of the QS audience present, a vital prerequisite to improving your communication style.

The D.I.S.C. system operates by proposing the following four types or styles of behaviour. We all have a mixture of these but sometimes one style is more prevalent;

DOMINANCE: how you approach problems and deal with challenges.  Some people are forceful, direct, results orientated;
INFLUENCING: how you interact with and attempt to influence people.  Some people are optimistic, fun, talkative;
STEADINESS: how you respond to change and levels of activity.  Some people are steady, patient, relaxed;
COMPLIANCE: how you respond to rules, procedures or constraints.  Some are precise, accurate, detail-oriented;

There were nearly 100 registered attendees at conference.  Scanning the photo’s taken the results of the DISC test in the room were;

Stephen Nayda had us spread around the four corners (self assessment tests in hand), in order if we identified with a high response level in one particular DISC group or near the middle if identified evenly with DISC.  It was a moment of truth as we stood and looked around the room in amazement as it was clear we had all empirically identified who we are personality wise regarding our natural style of communication.  There was stunned silence as the gravity of the room tilted towards the large mass in the High C corner. Sheep? No, reality? Yes ....  in a highly visual context, eye balling your peers. This is one of those conference moments you will not forget.

GST Changes - 1 October 2010

GST Changes - 1 October 2010

The three main areas affected by the increase in GST on 1 October 2010 are:

1.       Subcontractor Payments
2.       Creditors
3.       Client Payments

Fletcher Construction will be dealing with these as follows:

Subcontractor Payments

Subcontractor payment claims are not GST invoices.  Under the terms of the Fletcher Construction Subcontract Agreement and the terms of Section 24(2) of the GST Act 1985 and its amendments the subcontractor does not issue a tax invoice for a supply made in respect of the subcontract works. Fletcher Construction issues a tax invoice in respect of a taxable supply of goods and services made by a subcontractor.  Under the terms of the Subcontract Agreement, subcontractor claims for works to 30 September 2010 should be submitted no later than Friday 24 September 2010. Under the same agreement payment of these claims in due on Wednesday 27 October 2010.  At this time Fletcher Construction issues a buyer created tax invoice.  The GST component is calculated at the time of certification and payment, not at the time of the claim and will therefore include GST at the new rate of 15%.

Creditors

Creditor’s invoices for the supply of goods or materials in September and dated not later than 30 September 2010 should include GST at the old rate of 12.5% and will be paid on 20 October 2010 at that rate.  Creditor’s invoices for the supply of goods or materials in September but dated with an October date should include GST at the new rate of 15%. Credit notes sent in October 2010 or later for goods or materials invoiced prior to 30 September 2010 should include credit GST at 12.5%.

Client Payments

Fletcher Construction would generally submit its progress claims to Clients for work to the end of September on 1 October 2010. As with subcontractors the client’s payment schedule or payment certificate is generally the tax invoice and GST should be paid in October at the new rate of 15%. However, some clients insist that the contractor issues a tax invoice to them when the value of the progress claim has been agreed.  In this case Fletcher Construction would issue a tax invoice for this work dated the date the certificate was signed with a GST rate of 15%.

Linking QS practices with NZIQS
Code of Practice and Professional Conduct

The NZIQS Website Business Listings process provides an outlet for QS consultancies to be approved for listing on the website and advertising services if the business fulfills certain criteria.  The approved criteria are: Sole practitioners provided the sole practitioner is a qualified member of the NZIQS; Each branch office of a firm or practice provided 30% of the professional/technical staff in that office are qualified members of the NZIQS; Each branch office of a multi disciplinary firm or practice or construction company with a Quantity Surveying Division provided 30% of the employed professional/technical staff in the division of that office are qualified members of the NZIQS. Note 1-  at least one of that 30% of staff must be a Director, Partner or Shareholder; and ‘qualified member’ means MNZIQS, ANZIQS, FNZIQS or Life Member NZIQS.

Also a qualified member, preferably a Director, partner or shareholder, is required to take responsibility for the non-NZIQS -members in their practice, by making declaration that they take responsibility “ for the actions of all Directors, Partners, Shareholders and employees acting on behalf of this company or partnership, who are not members of the NZIQS and will ensure they abide by the NZIQS Code of Practice and Professional Conduct.”

The value of the undertaking sends a strong signal to the public that NZIQS expects high standards from practices formally associated with NZIQS.  It is a protection of the NZIQS member brand that any non-member in a business formally recognised and listed on the website complies with the same Code of Practice and Professional Conduct that qualified members do, especially Registered Quantity Surveyors who are also approved to list a contact directly on the website.  It is a fine line between undertaking and perception.  Every business card or letter signatory that confirms a firm’s individual is a NZIQS qualified member sends the same expectation as the explicit undertaking of a qualified member signing off on a NZIQS business listing.  Does your practice provide such a blanket undertaking?

The Registered QS list and the businesses listed are being referred to when queries are made by enquirers to the National office as current information is available for these members and businesses.

XD Notices – Annual Conference + Mentors Needed
NZIQS Annual Conferences

Traditionally NZIQS Annual Conferences were hosted from Branch to Branch annually and confirmed at each agm by an incoming Branch.  In the past 6-8 years this has not always proceeded smoothly. The Conferences, although always well run and valuable – even exciting – are a big task for any Branch of volunteers and in my view an attendance of 6 – 8% of members is poor..... especially when all who attend get great entertainment and 14 approved hours of CPD, plus excellent networking for one fifth or less of the cost of a two day commercial seminar.  It is a big effort and a lot of work and expense for all Branches and the Head office which absorbs $20,000 to $30,000 of sponsorship money for that small percentage of members.  I propose a new approach for Conferences to be considered and Council have requested Branch Boards to inform Council of their views.  I hope to attract a bigger attendance at conference and allow better coordinated publicity and sponsorship acceptance through having earlier notice of conference plans with some coordination with other bodies occasionally.  The 2011 Conference is to be hosted in Wellington as normal but my proposal plans future events as follows (to be reviewed annually);

2011         Wellington City
2012         Auckland City
2013         Combined with AIQS and PAQS (Melbourne)
2014         Hamilton
2015         Combined with other NZ Construction group – NZIOB?
2016         Otago – Dunedin
2017         NZIQS to host PAQS Conference - Auckland city
2018         Wellington Branch Provincial city e.g. Palmerston North, Masterton, Wanganui or New Plymouth.

Non-conforming Tenders & Conditions of Tendering

You would think tendering was about competition on an equal footing?  That the principal seeks to be able to accept a tender on the terms and scope proposed and then be able get on with the job.  Surely that is fair? Q. Have you been the originator or recipient of a tender that contains a tag (endorsement) like;

“There are some aspects of the Contract we wish to discuss and our offer is subject to the mutual agreement of these.”

Such a clause is almost certainly an endorsement or departure from the terms and scope requested and is not capable of being met with an ‘unconditional’ acceptance.  Whether or not such a clause is an endorsement and what the consequences of such an endorsement are, is solely the domain of the conditions of tendering. What is a Conforming Tender?

A conforming tender is one that meets the conditions outlined in the request for tender document.

What is a Non-Conforming Tender?

A tender is non-conforming when there is an absence of any requirement clearly detailed in the conditions of tendering. For example:

•Exclusions from tender price
•Not provide all information requested by the tender (at the required time).
•Qualification on materials/equipment which are different from those specified;
•Qualification on performance criteria of mechanical or electrical equipment;
•Qualification on time for completion which is different to that specified;
•Qualification on price submitted, e.g. Rise and fall basis instead of fixed price;

NZS3910:2003 conditions of tendering;

•clause 103.1 deals with “sufficiency” of the tender but only in the context of “tenderers inform themselves”;

•clause 104.3 deals with “endorsement”. “The Principal would prefer to receive tenders based on the tender documents, but reserves the right to consider any tender whether or not that tender has been submitted with endorsement”; and

•clause 107.2 notes “bone fide” tenderers are treated differently from other tenderers but only in terms of excluding tenders not submitted “in good faith” from receiving tender results information.

With the practical application of the tender process in the real world, many contracts are amended to permit the Principal to accept late tenders, talk directly to one or more tenderers, negotiate with one tenderer etc.  If contractors were to attempt to take the moral high ground and not submit bids on these terms they would soon be out of business!

Non-Conforming Tenders, even those not capable of ‘unconditional’ acceptance are permissible unless a Principal has prepared terms of strict compliance with tender requirements (with consequences for failure) in the conditions of tendering.  Otherwise let us not forget the general ‘preference’ of the Principal for conformity based on the tender documents.

Land Professionals Mutual Society Incorporated (LPMS) is a voluntary risk management organisation that represents the interests of surveyors and valuers and kindred professions with its principal objectives being;

  1. Guidance to members on the ways and means of avoiding or minimizing liability claims;
  2. Providing members with supportive claims assistance and administration including quality technical, legal and insurance assistance;
  3. Offering members access to especially tailored group professional indemnity and other liability insurance facilities on a voluntary basis.

LPMS has arranged group professional liability insurances for Member Firms since August 1976. Originally membership was restricted to consulting and land surveying practices but was expanded in 1983 to include valuers in public practice.  In 1985 membership was extended to kindred professions involving professional practices who provide consulting services in quantity surveying (including QS’s who practice as project managers), clerk of works, farm management, forestry, planning and property.
